ACCEPTANCE OF TERMS

By accessing, using, or scheduling services with Climax Aesthetic Surgery ("we," "us," "our," or "Company"), you ("you," "your," or "User") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Climax Aesthetic Surgery, a medical practice operated by Dr. Mary Ojo-Carons, located in Virginia Beach, Maryland, and New York.

DESCRIPTION OF SERVICES

Climax Aesthetic Surgery provides personalized wellness and aesthetic transformation programs including but not limited to:

Hormonal therapy and optimization

Peptide therapy

Regenerative PRP injections (O-Shot and P-Shot procedures)

SoftWave acoustic wave therapy

UroFill male enhancement procedures

GLP-1 weight loss programs

Intimate surgical procedures

Aesthetic and anti-aging treatments

Medical consultations and laboratory evaluations

Nutritional and lifestyle coaching

All services are provided under the direct supervision of Dr. Mary Ojo-Carons, a board-certified physician, and are intended for adult patients seeking hormonal balance, aesthetic enhancement, and sexual wellness.

ELIGIBILITY AND USER CONDUCT

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are of legal age and have the legal capacity to enter into this agreement.

You agree to:

Provide accurate, complete, and truthful information during consultations and medical evaluations

Follow all pre-treatment and post-treatment instructions provided by our medical staff

Disclose all relevant medical history, medications, and health conditions

Maintain confidentiality regarding other patients and proprietary treatment protocols

Respect our staff, facilities, and other patients

Comply with all applicable laws and regulations

You agree not to:

Misrepresent your identity, age, or medical condition

Use our services for any unlawful purpose

Share, reproduce, or distribute proprietary treatment information or protocols

Engage in disruptive, abusive, or inappropriate behavior

Record audio, video, or photographs without express written consent

No warranty or guarantee regarding treatment outcomes has been made

You must provide informed consent before any treatment begins. This includes understanding the nature of the procedure, potential risks, expected benefits, alternative treatments, and consequences of no treatment.

BILLING AND PAYMENT TERMS

Payment is due at the time services are rendered unless alternative arrangements have been made in writing. We accept cash, credit cards, and approved financing options.

Pricing varies by service type, with approximate ranges as follows:

UroFill sessions: $3,000-$6,000 per session

Combination therapy packages: Pricing determined during consultation

Individual treatments: Quoted during consultation

Payment Plans:

Customized payment plans may be available upon approval

Payment plan terms will be outlined in a separate agreement

Failure to make scheduled payments may result in treatment suspension

Cancellation and Refund Policy:

Consultations require 24-hour notice for cancellation to avoid fees

Treatment cancellations require 48-hour notice

Refunds for prepaid services are evaluated on a case-by-case basis

No refunds are provided for completed treatments

Refunds, if approved, will be processed within 30 business days

INTELLECTUAL PROPERTY RIGHTS

All content, materials, protocols, and proprietary information related to the Climax Regenerative Vitality System and our treatment methods are the exclusive intellectual property of Climax Aesthetic Surgery and Dr. Mary Ojo-Carons.

You may not:

Copy, reproduce, or distribute our proprietary treatment protocols

Use our trademarks, service marks, or trade names without permission

Reverse engineer or attempt to discover our proprietary methods

Share confidential treatment information with third parties

LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES

EMOTIONAL DISTRESS OR PAIN AND SUFFERING BEYOND DIRECT MEDICAL COMPLICATIONS

DAMAGES RESULTING FROM YOUR FAILURE TO FOLLOW TREATMENT INSTRUCTIONS

COMPLICATIONS ARISING FROM UNDISCLOSED MEDICAL CONDITIONS OR MEDICATIONS

Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

DISCLAIMER OF WARRANTIES

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE

WARRANTIES THAT SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Climax Aesthetic Surgery, Dr. Mary Ojo-Carons, and their employees, agents, and affiliates from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your violation of these Terms

Your misrepresentation of medical history or condition

Your failure to follow treatment instructions

Your violation of any applicable laws or regulations

Any claim that your use of our services infringes upon third-party rights

DISPUTE RESOLUTION AND ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

By a single arbitrator selected according to AAA rules

With each party bearing their own costs and attorneys' fees unless otherwise awarded

TERMINATION AND SUSPENSION

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for:

Violation of these Terms

Failure to pay for services

Inappropriate or disruptive behavior

Misrepresentation of medical information

Any conduct that threatens the safety of patients or staff

Upon termination:

Your right to use our services ceases immediately

We may retain your medical records as required by law

Outstanding payment obligations remain in effect

GOVERNING LAW AND JURISDICTION
